NEON Adds Antitrust Claims To Its Lawsuit Against IBM

AUSTIN, TX. – February 18, 2010 – NEON Enterprise Software today announced that on February 17, 2010 it amended its lawsuit to add antitrust claims based on alleged violations of the Sherman and Clayton Acts and state law claims based on section 329 of the New York Business Law. NEON alleges that IBM has a monopoly on the processing of Legacy Workloads on IBM Mainframe computers, a monopoly that annually generates billions of dollars in software licensing revenue for IBM.

On December 14, 2009, NEON Enterprise Software filed a lawsuit in connection with IBM’s efforts to prevent System z mainframe owners from using NEON zPrimeTM, a proprietary software product that enables IBM System z business application workloads – IMS, DB2, CICS, TSO/ISPF and batch – to run on IBM’s equally fast, lower-cost zIIP and zAAP specialty processors. Consumers throughout the United States, and the world, would benefit from the dramatic reduction in the cost of processing workloads on mainframe computers that is made possible with the use of zPrime. In the lawsuit, filed in the Austin Division of the United States District Court for the Western District of Texas, NEON originally alleged that IBM has violated the Lanham Act and state unfair competition laws, and that IBM is liable for business disparagement and tortious interference with prospective contracts.
